These Terms of Service ("Terms") govern access to and use of HarborBot, including the Discord bot, the web dashboard, and any related services (together, the "Service"), provided by HarborBot ("HarborBot," "we," "us," or "our"). By adding HarborBot to a Discord server, logging into the dashboard, or otherwise using the Service, you ("you" or "User") agree to be bound by these Terms. If you do not agree, do not use the Service.
HarborBot is a case-management and evidence-organization tool for Discord moderation teams. It captures message context when a report or flag is filed, groups related reports into cases, and routes alerts to a server's moderators.
HarborBot does not automatically warn, mute, kick, or ban anyone. It does not use artificial intelligence to decide who is at fault or take any disciplinary action. Every enforcement decision is made by a human moderator of the Discord server, acting under that server's own rules and Discord's Terms of Service — not by HarborBot. HarborBot is a tool that surfaces information; it is not a moderator, and we are not responsible for the moderation decisions a server's staff make using that information.
You must be at least 13 years old to use HarborBot, consistent with Discord's own minimum age requirement. By using the Service you represent that you meet this requirement and that your use of the Service complies with Discord's Terms of Service and Community Guidelines, in addition to these Terms. If you install HarborBot on a server, you represent that you have the authority to do so (e.g., as the server owner or an administrator with permission).
The web dashboard is accessed via Discord OAuth login. You are responsible for maintaining the security of your own Discord account and for all activity that occurs under it. Access to a given server's case data in the dashboard is limited to Discord users who hold the "Manage Server" permission (or equivalent) on that server at the time of access.

HarborBot offers a free tier and an optional paid "Premium" (Safe Harbor) tier with additional features. Premium is billed through Discord's own subscription system (Discord App Subscriptions). Discord, not HarborBot, processes the payment and holds your payment information; billing questions, refunds, and payment disputes are handled according to Discord's own terms and policies for App Subscriptions. We do not guarantee refunds directly and are not responsible for Discord's handling of billing. We may change what is included in the free or Premium tiers, or change Premium pricing, at any time; changes to pricing will not apply retroactively to a period you have already paid for.
"User Content" means reports, flags, case notes, and message data (including message snapshots captured for evidence purposes) submitted to or captured by the Service. You retain ownership of your own User Content. By using the Service, you grant HarborBot a license to store, process, and display that User Content solely as necessary to provide the Service (for example, showing a case's evidence to authorized moderators of that server). You are responsible for ensuring you have the right to submit any content you provide, and that doing so does not violate another person's rights or applicable law. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. Evidence capture depends on Discord's API and infrastructure outside our control, and we do not guarantee that message history will be captured completely, accurately, or at all in every case — for example, a message may already be deleted, edited, or otherwise unavailable by the time a report is filed, or Discord's API may be rate-limited or unavailable. We do not guarantee the Service will be uninterrupted, error-free, or available at all times, and we may modify, suspend, or discontinue any part of the Service at any time.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBORBOT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, REVENUE, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBORBOT'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS ($50). THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY THE CLAIM IS BASED ON. HARBORBOT IS NOT RESPONSIBLE FOR ANY MODERATION ACTION, DECISION, OR OUTCOME TAKEN BY A SERVER'S HUMAN MODERATORS, WHETHER OR NOT BASED ON INFORMATION THE SERVICE PROVIDED. Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless HarborBot from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party, including any action taken by a server's moderators based on a report or flag you submitted.
We may suspend or terminate your (or a server's) access to the Service at any time, with or without cause or notice, including for a violation of these Terms. You may stop using the Service at any time by removing HarborBot from your server. Sections of these Terms that by their nature should survive termination (including Sections 7-9 and 11-13) will survive.
We may modify these Terms at any time. If we make material changes, we will update the "Last updated" date above and, where practical, provide additional notice. Continuing to use the Service after changes take effect constitutes acceptance of the revised Terms.
The Service operates on top of Discord and relies on third-party infrastructure (including Discord's API and our database provider) that we do not control. We are not responsible for the availability, security, or policies of these third-party services. Your use of Discord itself remains governed by Discord's own Terms of Service and Privacy Policy.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. YOU AND HARBORBOT EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING. Arbitration will be conducted on an individual basis and administered under the rules of a reputable arbitration provider, seated in Texas, with proceedings conducted in English. If this arbitration agreement is found unenforceable as to a particular claim or remedy, that claim or remedy (and only that one) may be brought in the state or federal courts located in Texas, and both parties consent to personal jurisdiction there.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and HarborBot regarding the Service and supersede any prior agreements on this subject.
